What is a consent order?

A consent order is a formal agreement that sets out how your finances will be divided after divorce. It must be drafted clearly and approved by a judge. It can include:

  • How property will be divided

  • Pension sharing arrangements
  • Whether any spousal maintenance will be paid
  • Whether there will be a clean break

It’s submitted to the court after the Conditional Order stage and finalised once your Final Order is granted.

Even if everything is agreed now, divorce alone doesn’t end financial ties. Without a consent order, your ex could return years later to make a claim against your income, assets, or inheritance. A consent order gives you long-term financial protection, closure, and legal certainty.

When can I apply for one?
